Nintendo Argues Game Mods Aren't "Prior Art" In Palworld Lawsuit

Nintendo is embroiled in a legal battle against Palworld developer Pocketpair, alleging that user-made mods do not constitute "prior art" and could be patented by others. The company argues that mods, which require the original game to function, are "fair game" and its gameplay ideas and innovations could be lifted and used by anyone. However, Pocketpair claims that Palworld and Pokemon are fundamentally different games, despite similarities in their creature-capturing mechanics. The dispute is particularly concerning for the games industry, as it could allow patent thieves to create entire games from mods. Meanwhile, Nintendo is preparing to release the next entries in its Pokemon franchise, Legends: Z-A and Pokopia, for the Nintendo Switch.
