California enacts age-gate law for app stores

California has enacted a new law, AB 1043, which requires app stores and operating systems to implement age-gating for users. The law, which will take effect in 2027, categorizes users into four age groups (under 13, 13-16, 16-18, and adult) based on the age information provided by parents during device setup. This information will then be made available to app developers. The law aims to offer a more balanced approach to age verification, with a focus on privacy protection, compared to similar legislation in other states. Unlike previous laws, the new California law does not require users to upload photo IDs. Additionally, California has passed other laws related to internet regulation, including AB 56, which mandates social media platforms to display warning labels about the risks of using such platforms, and SB 243, which prohibits chatbots from being marketed as healthcare professionals. The legislation is part of a broader effort to address concerns around the impact of technology on minors, including issues related to self-harm content and nonconsensual distribution of sexually explicit material.
